These Terms apply to your use of the Moneycast Platform. When you register, we will ask for your name, email address and other related information in order to create an account (“Account”) for you. All registrations become the exclusive property of Moneycast. Moneycast reserves the right to use and reuse all registration and other personally identifiable user information subject to the Moneycast Privacy Policy which can be found in our Privacy Policy and governs our collection, use and disclosure of your personal and other information. By using the Platform, you agree to the terms and conditions of, and acknowledge receipt of, the Privacy Policy.

Moneycast owns all rights, title and interest in the Platform and our proprietary technology, including our software (in source and object forms), algorithms, user interface designs, architecture, and documentation (both printed and electronic), network designs, know-how, and trade secrets, and including any modifications, improvements, and derivative work thereof.Moneycast has the right, at any time, to amend our operating procedures and service level agreements, effective immediately following notification of such amendments to you. These Terms do not transfer from us to you any licence or ownership rights in the Platform or our proprietary technology. You may only use the Platform for the receipt and use of the Service and in a manner consistent with these Terms.

Moneycast presents users with operational intelligence information to better manage their businesses. To provide this, Moneycast takes advantage of Artificial Intelligence (AI) and Machine Learning (ML), as well as API technology and cloud computing. These services are either independently or collectively recognised as the 'Service'.
When you register for an account on the Platform, you permit Moneycast to collect information about your account transactions and present this to you through the creation of new or modified content to help you understand and manage your financial data. We do not check the accuracy of that information nor whether it is up to date. Accordingly, we make no warranty that our Service will be uninterrupted, timely or error free; or that the information presented (including any category tags applied by Moneycast) will be accurate or reliable. This means that you should not exclusively rely on such information when making decisions about your finances.We do not offer advice about financial products or investments. If you are not sure whether a product or service is suitable, which you may discover through the Platform, we recommend that you seek advice from a financial advisor. We are independent and support your own decision making. We do not promote any product or sponsored content to you directly in preference of any other service.
We may use sub-contractors to deliver some or all of the Service. We carefully select the sub-contractors that we use and they have agreed to follow our instructions and our data privacy requirements.

Moneycast owns all rights, title and interest (including intellectual property rights) in and to the Platform and our related website and technology. All Moneycast Platform and the content included in or made available through Moneycast Platform is protected by United States of America and international intellectual property laws. The Platform contents may not be copied, reproduced, modified, published, transmitted or distributed in any way without Moneycast’s prior written permission.
Certain of the names, logos, slogans and other materials displayed on/within the Moneycast Platform constitute trademarks, tradenames, service marks or logos (" Marks") of Moneycast or other entities. You are not authorised to use any such Marks without our written consent. Ownership of all such Marks and the goodwill associated with them remains with us or those other entities.
If you choose to give us feedback, suggestions or other inputs about the Platform, we may use them without restriction.

When you access or use the Platform, you agree to use the Platform only for purposes that are permitted by these Terms and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. In addition, you agree that you are solely responsible for any breach of your obligations under these Terms and for the consequences of any such breach. Whether on behalf of yourself or on behalf of any third party, you agree not to:

• Access or attempt to access or use the Platform other than through the interface that is provided by Moneycast, or through user accounts of others, unless you have specifically been permitted to do so in a separate written agreement signed by an authorised representative of Moneycast;
• Use the materials made available through the Platform for any purpose other than for use with the Moneycast Platform as governed by these Terms;
• Engage in any activity that disrupts or otherwise interferes with the Platform (or the servers and networks which are connected to the Platform), or the use of the same by others, as determined in Moneycast’s sole discretion;
• Conduct or promote any illegal activities while using the Platform;
• Attempt to reverse engineer or threaten the correct functioning of the Moneycast Platform, or otherwise attempt to derive the source code of the software (including the tools, methods, processes, and infrastructure) that enables or underlies the Moneycast platform and services;
• Upload or transmit any form of virus, worm, Trojan horse, or other malicious code;
• Divert or attempt to divert Moneycast customers to another website, mobile application, or service;
• Restrict or inhibit any other person from using the Site;
• Impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;
• Attempt to gain access to secured portions of the Platform to which you do not possess access rights;
• Scrape, duplicate, reproduce, copy, republish, licence, sell, trade or resell the Platform or any of its content for any purpose, unless you have specifically been permitted to do so in a separate written agreement signed by an authorised representative of Moneycast.

You must provide and/or obtain any equipment or telecommunications lines and links that may be necessary for you to use the Platform, and you acknowledge that certain software and equipment used by you may not be capable of supporting certain features of the Platform. You should also ensure any device used to connect with the Platform contains adequate anti-virus protection and appropriate firewall protections to prevent unauthorised access and use. Moneycast reserves the right to upgrade the functionality of the Service from time to time. This may require you to update, at your own cost, the functionality of other compatible software in order to ensure compatibility with the Platform. For the avoidance of doubt, we are not responsible for providing you with any equipment or telecommunications lines and links that may be necessary for you to use the Platform.

We are entitled to suspend your access to the Platform and/or otherwise restrict functionality if you are in breach of these Terms. In all such cases we will, to the extent permitted under Applicable Law, provide you with reasonable notice in advance of taking these steps. However, we may suspend your access to the Platform and/or otherwise restrict functionality without notice if you are using the Service in a manner that could cause us legal liability or disrupt other users’ ability to access and use the Service. Any suspension or restriction shall continue for such a period as we shall reasonably determine to be necessary.

If you provide or otherwise make available to Moneycast any suggestions, enhancement requests, recommendations, corrections, or other feedback (“Feedback”), whether related to the Platform or otherwise, then these Terms will also apply to such Feedback, and you hereby acknowledge and agree that such Feedback is not confidential information and that your provision of such Feedback is gratuitous, unsolicited and without restriction, and does not place Moneycast under any fiduciary or other obligation. You hereby grant Moneycast a royalty-free, worldwide, transferable, sub-licensable (through multiple layers), assignable, irrevocable and perpetual licence to implement, use, modify, commercially exploit, incorporate into the Platform, or otherwise use of any suggestions, enhancement requests, recommendations or other feedback Moneycast receives. Moneycast also reserves the right to seek intellectual property protection for any features, functionality or components that may be based on or that were initiated by such suggestions, enhancement requests, recommendations or other feedback. Moneycast shall have no obligation to use Feedback, and you shall have no obligation to provide Feedback.

The Platform may include links / integrations to third party sites. Such linked sites or available integrations are not under Moneycast’s control and Moneycast is not responsible for the contents of any linked sites or any links contained in any linked sites, or any changes or updates to such sites. The inclusion of any link/ integration does not imply endorsement of, or affiliation with, any third party site by Moneycast. Moneycast reserves the right to remove any links at any time. Your use of any third party content, software or services is at your own risk and is governed by the terms of the applicable provider, not these Terms.

We may conduct searches through an identity-referencing agency and through other sources of information and use scoring methods both to allow us to provide you with the Service and to assess our risks in doing so, including credit standing and compliance with all KYC/CDD requirements. A record of this process will be kept and may be used by Moneycast, or its subsidiary or parent companies, to similarly provide you with services and to assess our risks in doing so. Information may also be passed to other organisations or persons to prevent fraud. Additionally, information may be passed to governmental, regulatory or judicial organisations to prevent fraud or financial crime where we consider it appropriate.

The Platform is provided on an “as-is” and “as available” basis, and, to the extent permitted by applicable law, Moneycast (and our suppliers) expressly disclaim any and all warranties and conditions of any kind, whether express, implied, or statutory, including all warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We (and our suppliers) make no warranty that the Platform will meet your requirements, will be available on an uninterrupted, timely, secure, or error-free basis, or will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.

To the maximum extent permitted by law, in no event shall Moneycast (or our suppliers) be liable to you or any third party for any lost profits, lost data, costs of procurement of substitute products, or any indirect, consequential, exemplary, incidental, special or punitive damages arising from or relating to these Terms or your use of, or inability to use, the Platform, even if Moneycast has been advised of the possibility of such damages. Access to, and use of, the Platform is at your own discretion and risk, and you will be solely responsible for any damage to your device or computer system, or loss of data resulting therefromTo the maximum extent permitted by law, our liability to you for any damages arising from or related to these Terms (for any cause whatsoever and regardless of the form of the action), will at all times be limited to a maximum of fifty pounds sterling (GBP 50). The existence of more than one claim will not enlarge this limit. You agree that our suppliers will have no liability of any kind arising from or relating to these Terms.

We are not responsible for delays or deficiencies in functionality or performance that we reasonably cannot anticipate or that in otherwise are caused by circumstances outside our reasonable control (force majeure), including but not limited to events such as fire, flooding, explosion, riot, acts of war, hurricane, sabotage, acts of terrorism, vandalism, accidents, epidemic disease, government or governmental authority action, court injunction, strike or other similar events that may arise despite Moneycast’s reasonable effort to prevent, avoid, delay or mitigate effects of such events.

You agree to indemnify Moneycast (and its officers, employees, and agents), including costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of (a) your use of the Platform, (b) your violation of these Terms, or (c) your violation of applicable laws or regulations. Moneycast reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of these claims. You agree not to settle any matter without the prior written consent of Moneycast. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

Moneycast reserves the right to modify the Platform, including adding, amending, suspending, or removing functionality, features, material, and content on the Platform, and these Terms at any time, without notice. All provisions of these Terms which by their nature should survive termination shall survive the termination of your use and access to the Platform, including, without limitation, provisions regarding ownership, disclaimers, indemnity, and limitations of liability. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, such condition(s) shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

You may not assign any of your rights or delegate your obligations under these Terms, whether by operation of law or otherwise, without the prior written consent of us (not to be unreasonably withheld). We may assign these Terms in their entirety (including all terms and conditions incorporated herein by reference), without your consent, to a corporate affiliate or in connection with a merger, acquisition, corporate reorganisation or sale of all or substantially all of our assets.

Subject to this section, these Terms will remain in full force and effect while you use the Platform. We may suspend or terminate your rights to use the Platform at any time for any reason at our sole discretion, including for any use of the Platform in violation of these Terms. Upon termination of your rights under these Terms, your account and right to access and use the Platform will terminate immediately. You understand that any termination of your account may involve deletion of your data associated with your account from our live databases. Moneycast will not have any liability whatsoever to you for any termination of your rights under these Terms. 


Governing Law and Jurisdiction

This Agreement shall be governed by and constructed in accordance with the laws of the State of New York without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any jurisdiction other than the State of New York.
